Subrogation

Insurance companies do not ordinarily think of themselves as plaintiffs.  A carrier’s subrogation rights can exist under common law, equity, contract, or statute. Regardless of its origin, a carrier’s right of subrogation and its ability to recover a loss, large or small, is a fundamental right of the insurance industry.  A successful subrogation program can often mean the difference between profit and loss.

Ms. Lynn believes immediate investigation, especially in catastrophic losses, is essential to an effective subrogation program.  She will initiate an investigation of subrogation potential whenever there is a serious injury or catastrophic property loss, even in instances in which it appears there is no viable source of recovery.  It is paramount that this investigation is initiated while memories are fresh, witnesses are available, and the evidence has not been tampered with or destroyed.  As Terry typically works on a contingency basis for subrogation actions, her early involvement does not cost her clients any additional expense.  The fee arrangement also provides an incentive for her to quickly evaluate subrogation potential on the file, and to only prosecute those cases which have merit.

Coverage Litigation

Terry Lynn has served as both coverage and litigation counsel involving issues of bad faith, separate duty to defend, late notice, reservation of rights, estoppels, late notice by insureds, right to counsel, and consent to settle issues. Frequently, these are complex, multi-party actions filed in state or federal courts.  Terry’s experience in managing large cases has proven extremely valuable. Premises Liability

Since the 1980's, Terry has represented property owners involved in claims arising from third party criminal activity, slip and falls, trip and falls, and other alleged unsafe conditions. In the Commonwealth of Virginia, a property owner has a duty to maintain their property in a safe condition.  However, there are numerous defenses available for property owners. Based on her years of experience and the number of cases she has handled, Terry Lynn extends the highest standard of guidance, research and representation to property owners sued due to alleged unsafe conditions on their property.

Intentional Torts

Terry appears in courts in Virginia defending against claims involving fraud, assault and battery, defamation, and intentional infliction of emotional distress.  These cases can expose the client to damages not covered by insurance policies and involve an intent which is not present in ordinary negligence and personal injury cases.  In defending these claims, Terry focuses her efforts on protecting the client against the exposure of both excess compensatory and punitive damages.
